WITHOUT LIMITATION, SUCH CONTRACT INCLUDES GRANTS OF RIGHTS AND INDEMNITIES TO SPONSOR FROM YOU, A CLASS ACTION WAIVER, AND WHERE APPLICABLE, A LIMITATION OF YOUR RIGHTS AND REMEDIES.

Official Rules

1. ELIGIBILITY

The VIVERSE OPEN BRUSH Contest (the "Contest") is only open to those who, as of the start date, are legal residents of eligible countries, who have reached the age of majority in their state/country/location of residence. Employees of HTC Corporation and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Non-natural persons (including corporations and other business entities) are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, municipal, territorial and local laws and regulations and is void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. SPONSOR

3. Contest Period

The Contest begins on March 2, 2026, at 7:00 a.m. Pacific Time ("PT") and ends on April 3, 2026, at 11:59 p.m. PT for all Entrants (the "Contest Period"). Sponsor's servers are the official time-keeping device for the Contest.

4. Entries

Entrants must make their World in the Open Brush application located here: https://openbrush.app/. For clarity, your submission will be referred to as your "World" going forward. Follow the steps below to submit your creation:

  • 1. Download Open Brush

    • Install Open Brush on your VR headset. (Many headsets already come with Open Brush pre-installed)
  • 2. Create Your Project

    • Launch Open Brush.
    • Design and complete your project within the application.
  • 3. Create a VIVERSE Account

    • If you do not already have one, create a VIVERSE account at viverse.com.
  • 4. Connect Open Brush to VIVERSE

    • In Open Brush, navigate to the Accounts page.
    • Select VIVERSE.
    • A web browser window will open—enter your VIVERSE login credentials.
  • 5. Upload Your Project

    • After signing in, you will be redirected back to the Open Brush application.
    • Go to the Upload page.
    • Select VIVERSE to upload your project.
  • 6. Configure Your World Settings

    • Once uploaded, a browser window with a testable link will automatically open.
    • To finish setup, go to studio.viverse.com and:
      • Set your world to Public.
      • Customize your creator profile.
      • Review and finalize your world settings.
  • 7. Prepare for Competition Submission

    • Confirm that your world is public and accessible.
    • Save your testable link—you'll need it to complete your contest submission.

Once you have completed the above steps, please visit the Contest webpage located at https://www.viverse.com/events/open-brush during the Contest Period. Once on the Contest webpage, complete the entry form found here. All entries must include the following: • Email address associated with VIVERSE account • Full legal name • VIVERSE project link • Link to social post tagging #VIVERSE and promoting competition • Description of project. Then click the "Submit" button.

5. Entry Criteria

A. General Entry Requirements

By participating in the Contest, the Entrants represent and warrant that they have read and agree to all of the Contest Rules set forth in this document. For China residents, you represent and warrant that you have read and agree to the Processing and Cross-Border Transmission of Personal Sensitive Information Consent Form.

The World must be your original creation and may not include unlicensed copyrighted, trademarked, patented, or previously published material. The World must be submitted in the English language. The World may not display any unlicensed trademarked or copyrighted brand names/logos, except those of Sponsor's brands. The World shall not defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party's personal, proprietary, or intellectual rights. The World cannot contain illegal or unlawful material and must not promote any political agenda or contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively on the name, reputation or goodwill of the Sponsor, promote bigotry, racism, harm, or discrimination.

The World must be suitable for audiences of all ages. Entries which, in Sponsor's or judges' sole discretion, breach these conditions in part or in their entirety will be disqualified. Worlds that do not meet these stated criteria, or entries that, in Sponsor's or judges' sole discretion, may technically meet the stated criteria but do not reflect the intent and the spirit of the Contest, are not eligible. Sponsor reserves the right, at its sole discretion, to suspend, remove, or disable access to any entry or account if Sponsor believes the entry may infringe intellectual property rights, contain unlawful or inappropriate content, or otherwise pose reputational, legal, or security risks. Such action may be taken within prior notice and may result in disqualification from the Contest.

During the regional Contest Period the Sponsor VIVERSE Product Team will also be providing technical and other support on its official product Discord channel: #open-brush-2026.

Your entry constitutes Entrant's certification that s/he/they (i) are the owner of the World and (ii) are able and authorized to submit it.

Eligible Entrants receive one (1) entry into the Contest. Incomplete or indecipherable entries will be deemed invalid. Multiple entries are not permitted; each entry must be submitted or obtained in accordance with these Contest Official Rules.

By submitting your World, Entrant agrees to indemnify and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, sales representatives, agencies, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in this Contest from any and all claims, damages, expenses, costs (including reasonable attorney fees) and liabilities (including settlements), resulting from or relating to Entrant's submission, or any information supplied or represented to Sponsor by Entrant.

Except where prohibited, by participating in the Contest and winning any prize, Entrants agree to the use of his/her name, photo and/or likeness, biographical information, entry and statements attributed to Entrant (if true) for advertising and promotional purposes, without additional compensation. See the section on "Personal Information".

5B. Judging Criteria / Selection of Winners

Entries will be evaluated by a panel of judges selected by Sponsor, which may include Sponsor's employees and/or influencers. All decisions by the judges are final and binding on all entries.

A. Judging Categories

Judging will take place between April 4, 2026, through April 17, 2026. The theme of this Contest is "What makes you feel at home?". Judging will consist of one round where each entry will be evaluated on a 20-point scale as follows:

  • A maximum of 5 points for the concept. Your World will be evaluated on its relevance to the theme ("What makes you feel at home?") and a unique approach to immersive illustrations. The judging team will factor in your unique artistic style, taste, and approach to this immersive medium, with maximum scores being awarded for one-of-a-kind creative approaches to the theme of the competition.
  • A maximum of 10 points for craft. Your World will be evaluated for its attention to detail and careful construction. Top points will be awarded for projects that are aesthetically pleasing and evoke strong emotions, including joy, wonder, sadness, fear, or love, in the viewer through their carefully executed designs.
  • A maximum of 5 points for optimization. Your World will be evaluated on its performance in the web browser across multiple devices (Mobile, Desktop, and VR). Building the web requires creators to carefully budget their materials and to ensure that all users can access the experience. Top points will be awarded for creators whose projects are accessible on high-end mobile, desktop, and VR devices made in 2022 or later, such as Google Pixels, MacBook Pros, or VIVE Focus Visions.

The entries with the top three (3) highest point totals in the judging ("Potential Winners") will win a Prize depending on their accumulated score. In the event of a tie, the tied entry with the highest score for the concept scoring competent will be deemed the winner. In the event that the entries are still tied, the tied entry with the highest score for the craft will be deemed the winner. The award for the Most Viewed World will be given based on the number of unique users that have entered into the World on Viverse.com on the final day of the judging period. A view is defined as a unique user that has entered and stays for approximately thirty (30) seconds or more in a World.

Potential Winners will be notified by the Sponsor via the email that was given on the entry form within 2 working days of the completion of the Judging process. Each potential winner will be required to respond to the Sponsor's notification with the requested information within seven (7) days of the date of notice or attempted notice is sent. Reasonable efforts will be made to contact the Potential Winners. Once eligibility has been confirmed, the Potential Winners will be confirmed as a Winner. Winners will then be announced on or after April 20th, 2026.

If a Potential Winner of any prize cannot be contacted, fails to provide the requested information within the required time period or cannot accept the prize, the Potential Winner forfeits his/her/their prize and Sponsor reserves the right to disqualify that Potential Winner and award the Prize to a reserve Entrant selected in the same manner. Receiving a prize is contingent upon compliance with these Official Rules. In the event a potential winner is disqualified for any reason, Sponsor will award the applicable prize to next Entrants with the highest score.

Prizes will be fulfilled within thirty (30) working days after a Winner has been confirmed by emailing the Winner to redeem the prize by following the included instructions, which shall include but are not limited to requiring the winner to return a signed Affidavit of Eligibility and Liability, and any regional required tax forms to Sponsor. In the unlikely event that a Prize does not arrive within 28 days, the Winner must inform the Sponsor by emailing vivepr@htc.com. If a winner does not do so, Sponsor reserves the right to not reissue the Prize at its sole discretion.

6. Prizes

Prizes will be in the form of cash ("Prizes"). No other substitution shall be permitted. Sponsor will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to Prizes. Prizes will be fulfilled via a BACS transfer to bank accounts which must be valid and active in the country in which the Entrant has entered from.

The Prize(s) shall consist of the following:

Prizes for winning Entrant:
  • 1st Place: (Entrant with the highest score out of 20)
    • $2,500.00 USD per Entrant
  • 2nd Place: (Entrant with second highest score out of 20)
    • $1,500.00 USD per Entrant
  • 3rd Place: (Entrant with third highest score out of 20)
    • $1,000.00 USD per Entrant
  • Most Viewed: (Entrant with the most viewed world as described above)
    • $2,500.00 USD per Entrant

The value of the first-place Prize package is two thousand five hundred US dollars ($2,500.00 USD). The value of the second-place Prize is one thousand five hundred US dollars ($1,500.00 USD). The value of the third-place Prize is one thousand US dollars ($1,000.00 USD). The value of the most viewed prize is two thousand five hundred US dollars ($2,500.00 USD). The most viewed prize may be stacked with other prize packages if criteria have been met.

The Prizes are non-transferable, and no substitution will be made except as provided at the Sponsor's sole discretion. Sponsor reserves the right to substitute a Prize for one equal or greater value if the designated Prize should become unavailable for any reason.

Winners are responsible for providing correct bank account details, and the Sponsor will not be liable for any Prize payments made into the wrong bank account.

The Sponsor seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter a way that is not consistent with these Terms & Conditions, your entry (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months.

For this reason, the Sponsor reserves the right at any point to:

  • A. Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
  • B. Disqualify entries that are not made directly by the individual entering the Promotion.
  • C. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
  • D. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
  • E. Disqualify entries beyond the maximum allowed, or those using techniques such as 'script', 'brute force', masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
  • F. Disqualify entrants who tamper with the entry process.
  • G. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
  • H. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorized intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion. In such an event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the Prizes offered herein.

Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

7. Intellectual Property

A. Intellectual Property Rights. Except for the rights, title, and interest granted to HTC under these Rules or the VIVERSE World Terms of Use and VIVERSE Avatar Terms of Use (i) Entrants and/or University (depending on University Intellectual Property Agreements with their students) shall retain all right, title and interest in the World developed by Entrant hereunder and (ii) nothing in these Contest Rules shall create any right of ownership or license in and to the other Party's Intellectual Property Rights, and each Party shall continue to independently own and maintain its Intellectual Property Rights.

B. World License. Entrants hereby grant to Sponsor and its Affiliates a non-exclusive, irrevocable, worldwide, perpetual, transferable, sub-licensable, and royalty-free license under all its Intellectual Property Rights to copy, transmit, perform, display, modify, adapt, translate, and use the World (including all Intellectual Property Rights embodied therein) (i) in connection with trials and demonstrations of the World, and (ii) in connection with the marketing and promotion of the World along with the VIVERSE Platforms, and other VIVERSE products and services and (iii) for any use of derivative works, Sponsor does not need approval from Entrants for that use, nor will Sponsor be responsible for any additional fees.

7B. Indemnification

Entrants agree to defend, indemnify and hold Sponsor harmless against any and all losses, liability, damages and expenses (including reasonable attorneys' fees) arising out of or related to any third-party claims ("Claim") that is related to an allegation of intellectual property infringement, offensive content or malware attacks from the use of Entrant submission.

The Sponsor and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Contest or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law.

8. General Conditions

Where applicable, Sponsor will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances outside the control of the Sponsor.

9. Limitations of Liability

The Released Parties ("Released Parties") are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, typographical errors, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt or use or misuse of any Prize. If for any reason an Entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant's sole remedy is another entry in the Contest, if it is possible. No more than the stated number of Prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes by a random drawing among all legitimate, un-awarded, eligible Prize claims.

10. Disputes

Except where prohibited, Entrant agrees that: Regardless of conflict of laws principles of the applicable jurisdiction, the governing laws and the dispute resolution of these Content Rules shall be set in accordance with the place of Entrant's residence as follows: (a) North America, the laws of California in the United States govern the Contest Rules and the interpretation thereof, and venue and jurisdiction for any dispute arising under the Contest Rules shall lie in the state and/or federal courts located in Alameda County, California, USA; (b) Europe, these Official Rules shall be governed by the laws of the relevant country for each entrant and their interpretation and application will be subject to the exclusive jurisdiction of the courts of the relevant country they reside in,(c) China, any dispute arising from or in connection with the Contest Rules shall be submitted to Shanghai International Arbitration Center for arbitration and (d) Taiwan, any dispute arising from or in connection with Contest Rules shall be settled by arbitration in Taipei in the Mandarin Chinese language in accordance with the Taiwan Arbitration Act and the then-governing Arbitration Rules of the Chinese Arbitration Association, Taipei.

11. Entrant's Personal Information

Information collected from Entrants is subject to Sponsor's Privacy Policy:

By entering this Contest, the Entrants understand that they consent to providing their personal information to Sponsor to allow for the performance of the Contest by Sponsor.

12. Winner List

Provided no objection is received from the Winners, a winners list containing the surname, county and country of residence of the Winners will be made available by the Sponsor 4 weeks after the close of the Contest Period, for a period of 3 months. It will be available by sending a request via email to vivepr@htc.com with the subject line VIVERSE X OPEN BRUSH WINNER LIST. Winners can object to their details being published during the Winner Notification process. Without prejudice, the Sponsor will provide Winner information to any relevant Authority when requested by them.

If any part of these Official Rules is legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

If there is a discrepancy between these Official Rules and those in any promotional material, these Official Rules will prevail.

Processing and Cross-Border Transmission of Personal Sensitive Information Consent Form

I am willing to enter on my own initiative, the VIVERSE OPEN BRUSH Contest("Contest") sponsored by HTC America, Inc.

I am fully aware of the Term of Use of the Contest. I need to provide my original works to the Contest website at https://www.viverse.com/events/open-brush participate in the Contest. The Contest is sponsored by HTC America, Inc. 1625 Shattuck Ave, Suite 300 Berkeley, CA 94709.

By participating in the Contest, each entrant is granting authorization to his/her works for use on the VIVERSE global website.

Scenario and Purpose of Use Personal Information and Personal Sensitive Information

I acknowledge and consent that, in the scenarios of contest registration, works (Worlds defined in the T&C) display and exhibition, award granting, and VIVERSE promotional and marketing activities, the Sponsor and VIVERSE website operators will collect, store, use, make available, publish (collectively "Process") my personal information and/or personal sensitive information:

  • 1. When registering as a participant, I shall submit my real name and email address to the Sponsor; The Sponsor will organize technical training sessions on the use of the VIVERSE Platform as needed. The email address I submit to the contest webpage will be used to receive meeting notice.
  • 2. I have the right to choose, at my sole discretion, to publicly display my personal information and personal sensitive information (e.g., name, contact email, photograph and/or likeness, curriculum vitae, entrant declaration) alongside with my works. I recognize that the VIVERSE global website is a commercialized and publicly accessible website targeted at a global audience. Works and author description on the global website is public information. I consent to the VIVERSE global website making my personal information public that I choose to make available with my works on the VIVERSE global website. I acknowledge: By submitting my works, I agree that my name, photograph and/or likeness, curriculum vitae, entrant's declarations (if true) attached to my works will be used on the VIVERSE global website for purposes of promoting the works and for advertising and promotional purposes of VIVERSE. On my behalf, I consent to the VIVERSE global website processing my personal information when conducting publicity and promotion of my works.
  • 3. For the purpose of the activities of the Contest, HTC America, Inc. and its affiliates (including VIVERSE operators of the VIVERSE Website in the Participant's home country) may use my personal information to contact me (including but not limited to explanation of the contest rules, reply to competition results, communication about the receipt of prizes, etc.);
  • 4. If my works is awarded prizes, I shall provide the Sponsor: HTC America, Inc. with my valid contact phone number, ID card number, bank account and address information to be used for the purpose of receiving prizes. HTC America, Inc. and its global affiliates may use my personal information in the global promotion scenarios (including its official website, and public media) and activities in the announcement of the list of the awarded works and the relevant promotion activities of VIVERSE.
  • 5. The VIVERSE Website may promote other VIVERSE products and competition activities to my E-mail box.

Duration of Use: From my registration day of the Contest until my works is removed from the VIVERSE global website.

Entities authorized to use: HTC America, Inc., the host of the Contest and the entities which actually operates the VIVERSE website in participant's country. For example, if participant is a resident in China, the authorized entities are HTC Communication Co., Ltd and Fanshare Co., Ltd.
